Acceptance and Scope
These Terms of Service govern access to and use of Dizire Novel Engine, including its writing workspace, customer billing portal, support tools, AI-assisted features, exports, and related websites or services operated by AI Skunkworks, LLC.
By creating an account, purchasing a subscription, accessing the service, or using any workspace or billing feature, you agree to these Terms. If you do not agree, do not use the service.
- These Terms apply to both tenant workspace users and customer billing users.
- Additional order forms, invoices, or commercial agreements may supplement these Terms for enterprise or team customers.
Eligibility and Adult Content Boundary
Dizire Novel Engine is intended for adults. The platform may be used to plan, draft, revise, and publish adult-oriented fiction and related creative material.
- You must be at least 18 years old and legally able to enter into a binding contract to use the service.
- You are responsible for ensuring that your use of the platform, including any generated or uploaded content, complies with the laws and regulations applicable to you.
- You may not use the service to create, store, distribute, or request unlawful sexual content, child sexual abuse material, exploitative non-consensual material, or content that otherwise violates applicable law.
Accounts and Security
You are responsible for all activity under your accounts, including tenant logins, billing logins, API tokens, shared team access, and credentials issued to your organization.
- Provide accurate and current registration, billing, and contact information.
- Keep passwords, session tokens, backup codes, and API credentials confidential.
- Notify us promptly if you believe an account, payment method, or workspace has been compromised.
- We may suspend or restrict access where we reasonably believe an account is being used unlawfully, abusively, fraudulently, or in a way that threatens the platform or other users.
Subscriptions, Billing, Renewals, and Refunds
Paid access is sold through the billing flow shown at checkout. Pricing, billing intervals, introductory offers, applicable taxes, coupon adjustments, and renewal timing are described during signup or in your billing portal.
Founder or introductory pricing applies only as expressly described at checkout. Unless a separate written commitment says otherwise, promotional pricing does not create a perpetual entitlement beyond the stated offer window.
- You authorize us and our payment processors, including PayPal where used, to charge the payment method you provide for the selected subscription, add-ons, taxes, and any other agreed charges.
- Commercial or invoice-based accounts may remain pending, limited, or inactive until payment approval is confirmed.
- Fees are generally non-refundable once a billing period has started, except where required by law or expressly stated in a written refund policy.
- We may change pricing for future billing periods with reasonable advance notice through the service, billing portal, invoice, or email.
Your Content and Platform License
As between you and AI Skunkworks, LLC, you retain ownership of the manuscripts, outlines, prompts, notes, uploaded media, character data, exports, and other content you submit or create in the service, subject to third-party rights and applicable law.
You grant us a limited, non-exclusive license to host, reproduce, process, transmit, back up, secure, display, and transform your content only as needed to operate, support, improve, maintain, and provide the service to you.
- You represent that you have the rights needed to upload or use the content you place in the service.
- You remain responsible for the accuracy, legality, publishing rights, permissions, metadata, and downstream use of your content and exports.
- We do not claim ownership in your manuscripts, characters, or project assets merely because they are stored or processed through the platform.
AI-Assisted Features and Generated Output
The service may use AI or model-driven features to help generate, revise, summarize, classify, or transform creative material. AI output can be inaccurate, incomplete, repetitive, offensive, biased, or legally risky, and it may resemble content generated for others.
- You are solely responsible for reviewing, editing, validating, and deciding whether to use generated output.
- You must not rely on AI output as legal, tax, compliance, publishing-rights, or professional advice.
- We may use third-party model providers or self-hosted model infrastructure to process prompts and outputs as described in the Privacy Policy.
Acceptable Use
You may not misuse the platform, interfere with its operation, attempt to bypass limitations, or use it in a way that harms us, the platform, model providers, payment providers, or other users.
- No unlawful, fraudulent, deceptive, harassing, defamatory, or infringing use.
- No attempts to reverse engineer, scrape, overload, probe, or disrupt the platform, except where such restriction is prohibited by law.
- No use of the service to distribute malware, spam, credential theft, or unauthorized surveillance tools.
- No resale, sublicensing, or unauthorized provision of the hosted service to third parties except through approved commercial arrangements.
Service Availability, Changes, and Backups
We may add, remove, suspend, or change features, providers, workflows, pricing, or technical limits from time to time. We aim to keep the service available, but uninterrupted access is not guaranteed.
- You are responsible for maintaining any backups you require for critical projects or records.
- Scheduled maintenance, provider outages, rate limits, model changes, payment interruptions, and security events may affect availability or output quality.
- We may disable or retire experimental or beta features at any time.
Intellectual Property in the Service
The software, branding, interface design, service configuration, templates, code, and other platform materials made available by AI Skunkworks, LLC remain our property or the property of our licensors and are protected by applicable intellectual property laws.
- These Terms grant you a limited right to access and use the service during your subscription term.
- Except as expressly allowed by law or these Terms, you may not copy, distribute, modify, create derivative works from, or publicly exploit the service itself.
Termination and Suspension
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, create material risk to the platform, or where suspension is necessary for security, legal, or provider-compliance reasons.
- On termination, your right to access the service ends, but provisions that by nature should survive will continue, including payment obligations already incurred, intellectual property terms, disclaimers, indemnity, and limits of liability.
- We may preserve or delete data in accordance with our retention practices, legal obligations, and Privacy Policy.
Disclaimers, Liability Limits, and Indemnity
The service is provided on an as-is and as-available basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
To the fullest extent permitted by law, AI Skunkworks, LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, or business interruption arising from or related to the service.
- Our total liability for claims arising from the service will not exceed the amount you paid to us for the service during the 12 months before the event giving rise to the claim, unless applicable law requires otherwise.
- You agree to indemnify and hold AI Skunkworks, LLC harmless from claims, losses, liabilities, and expenses arising from your content, your misuse of the service, your violation of these Terms, or your violation of another party's rights.
Disputes, Governing Forum, and Intellectual Property Reports
If you have a billing dispute, service complaint, or charge concern, contact us first through the billing portal or our published company contact channels so we can attempt to resolve the issue before formal escalation.
Unless a separate written agreement says otherwise and except where prohibited by law, disputes related to the service will be brought in the state or federal courts with jurisdiction over AI Skunkworks, LLC's principal place of business, and each party consents to that forum.
- If you believe content or platform materials infringe your copyright or other intellectual property rights, send a written notice describing the work, the allegedly infringing material, your contact information, and the basis for your claim.
- We may remove, disable, or restrict access to allegedly infringing material while a complaint is being reviewed.
- If you believe a charge was made in error, contact billing support promptly before initiating a chargeback when reasonably possible.
Changes to These Terms and Contact
We may update these Terms from time to time. Material changes may be communicated through the service, checkout flow, billing portal, or related notices. Your continued use after an updated version becomes effective means you accept the revised Terms.
